JUDr. Andrea Baluch Oršulová, PhD.

Andrea is a managing partner with more than 25 years of experience advising clients in all areas of competition law. Her experience includes representing clients before competition authorities in cartel proceedings, abuse of dominance cases, and merger control matters. Andrea has extensive experience in preparing compliance programmes and conducting compliance training. In regulated industries, Andrea focuses on telecommunications and energy.

Legal advice mainly covers the areas of telecommunications and energy, including the preparation of legal analyses and opinions on regulatory obligations, as well as representation before regulatory authorities and Slovak courts.  

Legal advice mainly covers the following areas: 

  • Preparation of compliance programs, training for business entities, and implementation of compliance audits
  • Advice related to addressing the consequences of breaches of compliance regulations
  • Support in implementing compliance measures for undertakings
  • Support and advice during unannounced inspections (dawn raids)
  • Representation in investigations and proceedings before competition authorities or the European Commission in investigations of agreements restricting competition, cartel agreements, and agreements concluded between suppliers (vertical agreements)
  • Representation of undertakings before competition authorities or the European Commission in cases of abuse of dominant position
  • Support and advice in the area of merger control when assessing the obligation to notify a transaction to competition authorities

  • Advice in the area of private enforcement of competition law infringements and representation before national courts in private disputes related to private enforcement

Comprehensive advice on the Act on Unfair Terms in Food Trade, which includes in particular: 

  • Assessment of established contractual relationships from the perspective of compliance with regulatory obligations
  • Preparation of submissions to verify compliance with obligations in supplier-customer relationships
  • Representation before supervisory authorities and before the courts of the Slovak Republic in administrative proceedings
  • Representation before the courts of the Slovak Republic in cases of private enforcement of damages in connection with breaches of these regulations. 

Legal advice primarily includes the preparation of legal analyses in connection with compliance with state aid rules, consultations with national authorities and the European Commission, notification of state aid, and representation before courts in connection with private enforcement of state aid law. 

As part of legal advice in the area of public procurement, we provide support mainly in the following scope: 

  • Preparation of analyses and opinions related to compliance with public procurement rules and assessment of the use of appropriate procurement process concepts
  • Preparation of opinions on the evaluation of fulfillment of conditions for participation in public procurement
